1. Acceptance of Terms

By accessing and using Mr. Backsplash's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Mr. Backsplash provides professional kitchen backsplash installation services in Connecticut and New York, including:

  • Free instant online quote generation and project estimation with AI-powered accuracy
  • 24/7 AI chat assistant for questions, guidance, and contact requests
  • Professional tile installation for all backsplash types (ceramic, porcelain, glass, natural stone, marble)
  • Expert consultation and design guidance
  • Old backsplash demolition and removal services
  • Material sourcing assistance and recommendations
  • Professional grouting, sealing, and finishing
  • Project tracking and communication management
  • Automated booking, scheduling, and reminder system
  • Referral program with rewards for customer referrals
  • Post-installation warranty and support

3. Quotes and Pricing

Our automated online quote system provides a binding estimate based on the information and photos you provide, subject to on-site verification. Pricing may only vary if:

  • On-site measurement verification reveals different actual dimensions
  • Wall conditions, electrical outlets, or other site-specific factors differ from photos
  • Unforeseen complications discovered during demolition or installation
  • Changes in material selections or project scope after initial quote
  • Additional prep work required (wall repair, outlet relocation, etc.)
  • Local permit requirements or building code compliance needs

Quote Validity: All quotes are valid for 90 days from the date of issuance unless otherwise specified.

Pricing Includes: All installation labor (including grouting and finishing), the setting materials behind the tile (such as thinset/mortar), surface and area protection, and complete cleanup.

Not Included: Tile, grout, and trim materials — you purchase these yourself so you get exactly the look you want, and we install them. Also not included: wall repair, electrical work, plumbing modifications, or custom design consultations. Demo/removal of existing backsplash is included only if requested by the homeowner.

4. Customer Responsibilities

Customers are responsible for:

  • Providing accurate measurements, photos, and project information through our quote system
  • Ensuring clear access to work areas
  • Removing personal items and preparing the workspace
  • Obtaining necessary permits when required
  • Providing timely feedback and project decisions
  • Making payments according to agreed terms
  • Providing valid and accurate contact information
  • Notifying us promptly of any scheduling changes or concerns
  • Reviewing and accepting our Privacy Policy when using our services

4A. AI Chat Assistant Terms

AI-Powered Assistance: Our website features an AI chat assistant to provide instant answers to common questions about our services, materials, pricing, and installation process.

Limitations and Disclaimers:

  • The AI assistant provides general guidance and estimates only, not binding quotes or contracts
  • Responses are generated by artificial intelligence and may contain inaccuracies or errors
  • For official quotes, pricing, and project commitments, you must submit a formal quote request
  • Chat conversations are stored and may be reviewed for quality improvement
  • Contact information provided in chat will trigger follow-up from our team
  • The AI assistant cannot modify bookings, process payments, or make binding commitments

Human Verification: All project details, pricing, and scheduling must be confirmed by a human team member before they are considered final.

4B. Communication Terms

By providing your contact information, you agree to:

  • Provide accurate and complete contact information
  • Accept transactional emails and communications related to your project
  • Notify us promptly of any changes to your contact information
  • Respond to project-related inquiries in a timely manner
  • Not use our services for fraudulent or unlawful purposes

We reserve the right to refuse service to any customer who violates these terms or engages in fraudulent activity.

5. Warranty and Liability

We provide a 2-year limited warranty on installation workmanship under the following conditions:

  • Warranty covers only defects caused by poor installation workmanship
  • Material defects are covered under manufacturer warranties
  • Claims must be reported in writing within 30 days of discovery
  • We reserve the right to inspect and verify all warranty claims
  • Our sole obligation is repair or replacement at our discretion and cost
  • Warranty becomes void if unauthorized repairs or alterations are made by any party other than Mr. Backsplash

Warranty exclusions include but are not limited to:

  • Normal wear, tear, settling, or aging of materials
  • Damage from impacts, scratches, or customer modifications
  • Issues arising from customer-supplied materials or design specifications
  • Moisture damage, plumbing leaks, or structural movement
  • Damage from cleaning products, chemicals, or improper maintenance
  • Color variations, natural stone characteristics, or aesthetic preferences
  • Changes in building codes or regulations after installation

Limitation of liability: Our total liability is limited to the original contract value. We are not responsible for consequential, incidental, or indirect damages including but not limited to loss of use, inconvenience, or other property damage.

This warranty gives you specific legal rights, and you may also have other rights that vary by state. Nothing in these terms limits any warranty or remedy that Connecticut or New York law provides and does not allow to be waived.

6. Payment Terms

Standard Payment Schedule:

  • Free quote - No payment required to get your estimate
  • A deposit — typically 50% — is required to secure your installation date; your quote states the exact amount
  • Final 50% payment due upon project completion
  • Progress payments may be required for projects exceeding $10,000

Payment Methods: We accept Zelle, Venmo, or debit/credit card. Card payments are made through a secure online payment link; to pay by Zelle or Venmo, text us at (914) 980-4201 before paying so the payment is recorded against your project. All online payments are processed securely with industry-standard encryption.

Late Payments: Final payments not received within 7 days of completion may incur a late fee of 1.5% per month, or the maximum rate permitted by applicable Connecticut or New York law for your project location, whichever is less.

Returned Payments: A $100 fee will be charged for any returned or insufficient funds payments.

Refund Processing: Approved refunds are initiated within 48 hours of your cancellation request to the original payment method. Length of settlement depends on your card issuer.

7. Cancellation Policy

Cancel Anytime Guarantee: You may cancel your project at any time. If you cancel before installation begins, you receive a full refund of all amounts paid. Where you paid by card, the refund is less the transaction processing fee our payment processor keeps on a refunded charge (2.9% + $0.30 per transaction); payments made by Zelle or Venmo carry no such fee and are refunded in full. Once installation has begun, you remain responsible for the value of work completed and materials already installed; any remaining balance is refunded on the same terms.

Refunds are initiated within 48 hours of your cancellation request. A card refund settles on your card issuer’s timetable; a Zelle or Venmo refund is sent back the same way you paid.

Your Statutory Cancellation Rights: In addition to — and never limited by — the guarantee above, Connecticut and New York home improvement laws give you the right to cancel a home improvement contract without penalty within three business days of signing it. If you cancel within that statutory window, you receive a full refund of everything paid, with no deduction of any kind. Notice of this right, and a cancellation form, are included with every written contract as required by law.

7A. Home Improvement Contracts and Licensing

Mr. Backsplash is licensed and insured for home improvement work in Connecticut and New York. Our registration and license information appears on every written contract and is available on request.

All installation work is performed under a written home improvement contract that includes the terms required by Connecticut and New York law — including the parties' names and addresses, a description of the work, the price and payment schedule, start and completion dates, and notice of your cancellation rights. In the event of any conflict between these website Terms and your signed contract, the signed contract governs the work.

8. Force Majeure

Neither party shall be liable for any failure or delay in performance under this agreement which is due to fire, flood, earthquake, elements of nature, acts of God, or other causes beyond the reasonable control of either party.

9. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict of law provisions. You consent to the exclusive jurisdiction and venue of courts located in Fairfield County, Connecticut, for all disputes arising from these terms or our services.

New York Carve-Out: For projects physically performed in New York, New York law governs the work performed in that state, and venue for disputes specific to those projects lies in Westchester County, New York.

10. Automated Communications and Notifications

By using our services, you consent to receive automated communications including:

  • Quote confirmations and project estimates via email
  • Booking confirmations and payment receipts
  • Appointment reminders via email and SMS (if provided)
  • Project status updates and completion notifications
  • Review requests after project completion
  • Referral program updates and reward notifications
  • Administrative notices related to your account or project

You may opt out of promotional communications at any time, but transactional and service-related communications are necessary for project fulfillment. 10A. Referral Program Terms

Referral Rewards: Our referral program allows customers to refer new customers in exchange for a 10% commission on the completed project labor value. Terms and conditions:

Eligibility and Conditions:

  • Referees must be new customers who have not previously used our services or been referred by another party
  • Commission is calculated as 10% of the total project labor cost, excluding customer-purchased materials, permits, or third-party services
  • Commission is earned only after the referred project is fully completed and paid in full by the referred customer
  • Commission amounts are not guaranteed until payment is processed and may be adjusted if project scope changes
  • Commission payments are processed within 10 business days of project completion and full payment

Verification and Fraud Prevention:

  • We reserve the right to verify all referrals and deny commission for fraudulent, duplicate, or suspicious submissions
  • The following referrals are not eligible for commission:
    • Self-referrals
    • Referrals to immediate family members residing at the same address
    • Referrals submitted after the referred party has already contacted Mr. Backsplash
  • Referral fraud or abuse will result in forfeiture of all pending and future rewards

Program Modifications and Disputes:

  • Mr. Backsplash reserves the right to modify, suspend, or terminate the referral program at any time without prior notice
  • Commission rates and terms are subject to change; the rate in effect at the time of referral submission applies
  • In the event of a dispute regarding commission eligibility or amount, Mr. Backsplash's determination shall be final
  • If the referred project results in a chargeback, refund, or non-payment, any associated commission may be withheld or reclaimed

Tax Liability:

  • Referral commissions may be considered taxable income; you are solely responsible for reporting and paying any applicable taxes
  • We may request tax identification information (e.g., W-9) for commissions exceeding $600 annually as required by IRS regulations

Payment Methods:

  • Commission payments are made by Stripe transfer. We send you a claim link; you provide your payout details to Stripe directly, and we never see or store your bank information
  • If a Stripe transfer is not workable for you, contact us at [email protected] and we will arrange an alternative
  • Payments are processed within 10 business days following project completion and full payment
  • You are responsible for providing accurate payment information; we are not liable for payments sent to incorrect accounts
  • Rewards cannot be combined with other promotions unless explicitly stated

10B. Portfolio Images and Intellectual Property

Project Portfolio: All backsplash installation images displayed in our portfolio and gallery sections represent actual projects completed by Mr. Backsplash. These images are owned by Mr. Backsplash and are protected by copyright law.

Intellectual Property: All content, including but not limited to text, graphics, logos, images, project photos, website design, and software, are the exclusive property of Mr. Backsplash or used with permission. Unauthorized copying, reproduction, distribution, or commercial use is strictly prohibited.

Customer Photos & Reviews: By allowing us to photograph your completed project or submitting a review, you grant Mr. Backsplash a perpetual, non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content for marketing, advertising, and promotional purposes across all media (website, social media, print materials, etc.).

Customer Privacy: We will not disclose your personal information (name, address) in connection with project photos without your explicit written consent.

11. Disclaimers and Limitation of Liability

SERVICE "AS IS": Our website and services are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

LIMITATION OF LIABILITY: To the maximum extent permitted by law, Mr. Backsplash shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from your use of our services.

TOTAL LIABILITY CAP: Our total liability to you for all claims arising from or relating to these terms or our services shall not exceed the amount you paid us in the twelve months preceding the claim.

INDEMNIFICATION: You agree to indemnify and hold harmless Mr. Backsplash from claims, damages, or expenses arising solely from your intentional misconduct, misrepresentation of project conditions, or material breach of these terms.

12. Dispute Resolution

Good Faith Resolution: In the event of any dispute, we encourage customers to contact us first to resolve the matter amicably. Most concerns can be addressed through direct communication.

Mediation: If direct resolution is unsuccessful, both parties agree to participate in non-binding mediation before pursuing arbitration or litigation.

Arbitration: Any disputes that cannot be resolved through mediation shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Construction Industry Arbitration Rules. Arbitration shall take place in Fairfield County, Connecticut, or Westchester County, New York (based on project location).

Small Claims Exception: Either party may pursue claims in small claims court if the claim qualifies and remains in small claims court.

Class Action Waiver: You and Mr. Backsplash agree to resolve disputes only on an individual basis. You waive any right to participate in a class action, collective action, or class-wide arbitration against Mr. Backsplash.

30-Day Opt-Out: You may opt out of the arbitration agreement and class action waiver in this Section 12 by sending written notice to [email protected] within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms.

13. Additional Legal Provisions

Severability: If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement: These Terms of Use, along with our Privacy Policy and any signed contract for services, constitute the entire agreement between you and Mr. Backsplash and supersede all prior agreements, representations, or understandings.

Waiver: No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these terms or any rights hereunder without our prior written consent. We may assign these terms without restriction.

Changes to Terms: We reserve the right to modify these terms at any time. Material changes will be notified via email or prominent website notice at least 30 days before taking effect.
